Murdered peasant soldier by action of a mine field and the sowing of explosives

On April 21 2007 at 10:00 am, narco terrorists from the Farc 21 squad murdered the peasant soldier Darío Fabián Ortíz Useche, when he activated a mine field prepared by the Farc.
The fact previously mentioned occurred in the San José county, San Antonio municipality, Tolima Department.
The behavior perpetrated by the Farc by the light of the internal norms - Law 599 of 2000 constitute several crimes, among them Increased Homicide established in the Article 103 in agreement with the Article 104 Nº8 that points out that the aggravation circumstances, as it is in this case the homicide carried out by the Farc with terrorist purposes or in development of terrorist activities. Equally, with this criminal act, the Farc are also involved in the crime pointed out in the article 142, as it is the usage of means and illicit war methods.
The Farc are also infringing the added article 367, Article 2, Law 759 of 2002, which establishes as crime the usage, production, commercialization and storage of antipersonnel mines.
In turn, this Farc criminal action constitutes a serious infraction to the International Humanitarian Law included in the1997 Ottawa Convention - approved by the Law 454 of 2000. Also, it is important to remember that this it is a war crime according to that prescribed in the International Penalty Court’s article 8 of the 1998 Statute - approved by the Law 742 of 2000.
Once again the Farc inside its criminal policy uses the mines and the trap weapons in a deliberate and indiscriminate way against people when locating them in free mobilization areas, causing disproportionate noxious effects impacting their implementation in the displacement of peasants toward other regions generating terror and fear.
